Officials Cases - Paint Company Fined $90,000 After Worker Crushed

The failure of a power hoist, which caused serious crush injuries to a contract worker, has resulted in a Padstow company being fined $90,000.

Orica Australia Pty Ltd, trading as Dulux, was fined by the NSW Industrial Relations Commission sitting in court session after pleading guilty to a breach of Section 16(1) of the Occupational Health and Safety Act 1983.

The worker, who lost consciousness after the power hoist jammed him against the inside of a storage tank on 12 August, 1998, suffered fractured ribs and vertebrae and severe bruising.

In October 2001, the contract company which employed the worker, Anytime Industrial Services Pty Ltd, was fined $30,000 by the Industrial Relations Commission after pleading guilty to a breach of the Occupational Health & Safety Act 1983.

WorkCover General Manager Kate McKenzie commented: "In this case the company failed to identify and remove foreseeable risks to the health and safety of contract workers on its premises."
