How should an employer deal with a workers compensation claim?
Answer
If a worker is injured, as an employer, you must:
- notify your insurance company within 48 hours of becoming aware of any workplace injury that seems to be a significant injury. A significant injury is where the worker is likely to be away from their normal duties for 7 or more calendar days.
- if the injury does not seem to be a significant injury, you must notify the insurance company within 7 days of becoming aware of the injury.
- for significant injuries supported by a WorkCover medical certificate, you must also complete and return an Accident Report Form to your nearest WorkCover office. This applies whether the injured person is a worker, contractor or visitor to your workplace.
- co-operate and participate in the establishment of an injury management plan for your injured worker. Your insurance company should contact you and the worker within 3 days of receiving notice of injury, to get this plan underway.
- provide suitable employment for an injured worker wherever possible. The employment must be suited to the worker, having regard to the workers injury and the employment the worker was in at the time of injury.
- notify your insurance company if unable to provide suitable employment. (Note that failure to provide suitable duties at the request of a worker may have an impact on your workers compensation premiums.)
If a worker wants to make a workers compensation claim, as an employer you must:
- notify the insurance company that a worker wants to claim workers compensation, even if you don't agree that the injury is work related. The insurance company will ask you and your worker for facts about what happened.
- send the workers compensation claim form (if required by the insurance company), medical certificate or further documentation related to the claim to your insurer within 7 days of receiving them.
- provide the name and address of your workers compensation insurance company to an injured worker if requested.
- pay the worker any money received for workers compensation benefits as soon as practicable.
