Question

My claim has been declined. What can I do?

Answer

When an insurer denies liability or further liability for a claim, the insurance company must write to you to tell you this, giving the reasons for declining the claim.

If you don't understand or agree with the decision contact the insurance company and ask to speak to the claims officer and request that the decision be reviewed. If you need help or advice on what you should do contact the WorkCover Assistance Service on 13 10 50.

If you don't agree with the decision contact one of the organisations below, depending on your occupation.

For most workers

The Workers Compensation Commission (WCC) handles conciliation of all claims for most workers. Application forms for conciliation are available directly from the WCC or the WorkCover Assistance Service (phone 13 10 50).

If you are a coal miner

If you are a coal miner and you are not satisfied with the insurance company's decision, you can apply to have your case heard by the Compensation Court. There are four registry offices of the Compensation Court in NSW. Follow the link to find the registry closest to you.
